@design_law actually I don't think background matters just - do you know the law? Many general judges in senior courts don't really know IP

@design_law I am no sure that is so - often the relevant IP background is trade marks not patents so not just technical people.

@design_law depends on the country and the level of court but in many cases including CJEU not at all. That is the problem.

Surprised to hear DE judge say counterclaims difficult to succeed - design applications not examined so surely easy to invalidate #rcd10

The problem IMHO that it is in the interests of the party with a weak case to maintain lack of understanding of generalist judge #rcd10
